Terms of Service

1. These terms

These Terms of Service govern your use of CallAssist™ ("CallAssist," "we," "us"), an AI phone-answering and appointment-booking service for trade and service businesses. By starting a trial, creating an account, or using the service, you agree to these terms. If you are agreeing on behalf of a business, you confirm you have authority to bind that business.

Our Privacy Policy is part of these terms.

2. What the service does

CallAssist answers calls to a phone number you forward to us or that we provide, speaks with your callers, qualifies leads, books appointments on your calendar, and sends you summaries by text and email. You manage your settings and review your calls and bookings in the customer portal at my.callassist.tech.

3. Free trial

New customers get 14 days free. No credit card is required to start. During the trial the assistant answers your real calls. You can cancel at any time during the trial and you will not be charged.

4. Price, billing, and cancellation

  • CallAssist Core is $397 per month. Optional add-ons are priced separately and shown before you buy.
  • Billing starts when your free trial ends, unless you cancel first.
  • Plans are month-to-month. There is no contract and no cancellation fee.
  • Payments are processed by Stripe. By providing a payment method you authorize us to charge it on a recurring monthly basis until you cancel.
  • You can cancel at any time from your dashboard or by contacting us. Cancellation takes effect at the end of the current billing period; the service keeps running until then.
  • Fees are non-refundable except where required by law or where we agree otherwise in writing. Prices exclude any applicable taxes.
  • If we change pricing, we will give existing customers at least 30 days' notice before it applies to them.

5. Your responsibilities

You are responsible for how the service is configured and used for your business. In particular, you agree to:

  • Give us accurate business information, and keep your settings, hours, and services current
  • Comply with all laws that apply to your calls and messages — including the Telephone Consumer Protection Act (TCPA), carrier A2P/10DLC registration requirements, and Do-Not-Call rules
  • Obtain the consent you need before we send text messages on your behalf, and honor opt-out requests
  • Disclose call recording where the law requires it. Some states require every party on a call to consent to recording. Your greeting settings let you provide that notice; using them is your responsibility
  • Keep your account login secure and tell us promptly if you suspect unauthorized access

6. About the AI assistant

The assistant is automated software, not a person. It is designed to sound natural and to use your business name and tone, and it will not claim to be human if a caller asks directly.

Like any software, it can misunderstand a caller, mis-hear a detail, or book something incorrectly. You are responsible for reviewing your calls and bookings. CallAssist is not an emergency service. It cannot dispatch help, and it must not be relied on for emergency, medical, safety, or life-critical calls. Callers with an emergency should hang up and dial 911.

7. Acceptable use

You may not use CallAssist to send unsolicited marketing calls or texts, to harass or defraud anyone, to impersonate another business, to handle emergency or crisis lines, or for any unlawful purpose. We may suspend or terminate accounts that do, or that put our carrier or platform relationships at risk.

8. Phone numbers

If we provide a phone number for your account, you may use it while your subscription is active. Numbers we assign are not sold to you and may not be transferable when you cancel — ask us before you rely on porting one out. If you forward your existing number to us, that number remains yours and you can stop forwarding at any time.

9. Availability

We work to keep the service running around the clock, but we do not guarantee uninterrupted service. CallAssist depends on telephone carriers, internet connectivity, and third-party platforms that we do not control, and it may be unavailable during outages or maintenance. We do not offer a service-level guarantee or outage credits.

10. Third-party services

The service is built on third-party platforms, including HighLevel/LeadConnector, telephone and SMS carriers, Stripe, Cloudflare, and speech and language AI providers. Their availability and terms affect the service.

11. Your data

You keep ownership of your business information and your call and message records. You grant us the license needed to host and process that data to run the service. On request after cancellation, we will delete your data except where we are required to keep it. See the Privacy Policy.

12. Our intellectual property

CallAssist, its software, prompts, designs, and the CallAssist™ name and marks belong to us. You get a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. You may not copy, resell, reverse-engineer, or white-label the service without our written permission.

13. Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise any particular number of calls answered, leads captured, appointments booked, or revenue earned.

14. Limitation of liability

To the fullest extent permitted by law, CallAssist is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or missed opportunities — including from a missed, dropped, mishandled, or incorrectly booked call. Our total liability for any claim is limited to the amount you paid us in the three months before the event giving rise to the claim.

15. Indemnification

You agree to indemnify and hold CallAssist harmless from claims arising out of your use of the service, your content and greetings, and your failure to comply with laws that apply to your calls and messages — including TCPA and call-recording claims.

16. Suspension and termination

You may cancel at any time. We may suspend or terminate an account for non-payment, for violation of these terms, or if required by a carrier or platform we depend on. We will give reasonable notice where we can.

17. Changes to these terms

We may update these terms. If a change is material, we will notify customers by email and update the effective date above. Continuing to use the service after a change means you accept it.

18. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Palm Beach County, Florida, and both parties consent to that jurisdiction.

SMS & text messaging

By opting in on our website or by texting or calling us first, you agree to receive informational and transactional text messages from CallAssist™ (Remote Tech Expert Inc). Message frequency varies. Message and data rates may apply, and you are responsible for any charges from your mobile carrier. Reply STOP to any message to opt out immediately; text HELP or email [email protected] for help. Wireless carriers are not liable for delayed or undelivered messages. You must be at least 18 years of age to use CallAssist and to consent to receive text messages.
